Violence Against Women Act, the Campus Sexual Violence Act, and Title IX

Atlantic Cape Community College is committed to providing an institutional environment where all persons may pursue their studies, careers, duties, and activities in an atmosphere free of threat of unwelcome and unwanted sexual actions. The college strongly condemns sexual offenses, will not tolerate sexual offenders, and supports those who have been victimized.

Atlantic Cape is committed to taking all steps to eliminate violence against members of our community. The college will fully comply with the federal Violence Against Women Act, the Campus Sexual Violence Elimination Act ("SaVE Act") which is part of Violence Against Women Act and Title IX regulations prohibiting sexual harassment, sexual assault as defined in 20 U.S.C. 1092(f)(6)(A)(v), dating violence as defined in 34 U.S.C. 12291(a)(10), domestic violence as defined in 34 U.S.C. 12291(a)(8), or stalking as defined in 34 U.S.C. 12291(a)(30)., including assault.

Sexual assaults are serious violations of the college's student code of conduct and college employee policies. Such violations are processed through the college’s code of conduct and a Title IX hearing and are also punishable by fines or imprisonment under state and federal laws. In addition, these actions are subject to civil suit for damages.

In complying with Title IX regulations, no actions taken by the college under this policy are intended to restrict those rights protected under the U.S. Constitution including the First Amendment, Fifth Amendment and Fourteenth Amendment. Furthermore, this policy shall not be construed or applied to restrict academic freedom, nor shall it be construed to restrict constitutionally protected expression, even though such expression may be offensive, unpleasant, or even hateful.
